2. Who Is Responsible for Your Information?
OXUS HUB LTD is generally the data controller responsible for personal information collected directly from individual customers.
Where Smart Car Tracker is provided to a business, fleet operator or employer, that organisation may be the data controller for vehicle, driver and journey information. In those circumstances, OXUS HUB LTD may process the information on that organisation’s behalf.
Business customers and account holders are responsible for ensuring they have lawful authority to track their vehicles and that drivers and other affected individuals are properly informed.
3. Information We Collect
Account and Contact Information
We may collect your name, email address, telephone number, account username, authentication information and company or fleet information.
Vehicle and Location Information
We may collect precise or approximate GPS locations, live and historical vehicle locations, journey routes, dates, times, distances, vehicle identifiers, tracking-device identifiers, geofence activity, alerts and other telematics information provided by the installed tracking device.
Location information may be collected continuously by an installed GPS tracker, including when the Smart Car Tracker application is closed or not actively being used.
Technical and Usage Information
We may collect your IP address, device type, operating system, browser information, application activity, login records, crash reports, diagnostic information and security or fraud-prevention records.
Payment Information
We may collect billing details, subscription information and transaction references. Complete payment-card or bank-account details may be processed directly by our payment providers and may not be stored by us.
Communications
We may retain messages, customer-support requests and other communications you send to us.
4. How We Collect Information
We may collect information directly from you when you register, subscribe or contact us. Information may also be collected automatically when you use our websites, applications or services.
Vehicle and location information may be received from GPS tracking devices installed in registered vehicles. We may also receive information from a business, fleet operator or account administrator that gives you access to the service, as well as from payment providers and other service providers.
5. How We Use Your Information
We use personal information to create and manage user accounts, provide live vehicle tracking and journey information, deliver geofence alerts and other tracking features, manage subscriptions and billing, provide customer support, maintain and improve our services, diagnose technical problems, prevent fraud or unauthorised access, communicate important service information, comply with legal obligations and establish or defend legal claims.
We do not sell personal information or vehicle-location data.
6. Our Lawful Bases for Processing
We may process personal information where it is necessary to perform a contract and provide the Smart Car Tracker service requested by you.
We may rely on our legitimate interests to operate, secure, maintain and improve our services and prevent fraud, provided those interests do not override your rights.
We may process or retain information where necessary to comply with legal obligations.
Where consent is required, including for certain cookies, marketing communications or device permissions, you may withdraw your consent at any time.
7. Location Tracking and Driver Responsibilities
Smart Car Tracker is designed to monitor the location and activity of registered vehicles. Location data may be collected and transmitted by an installed GPS device while the vehicle is operating or parked.
The person or organisation registering a vehicle must own the vehicle or have lawful authority to track it. They must inform drivers and other affected individuals that tracking is taking place, use the service only for lawful purposes and avoid using Smart Car Tracker for covert, unlawful or unauthorised surveillance.
8. Sharing Personal Information
We may share information with cloud-hosting and data-storage providers, mapping and telematics providers, payment processors, communication and customer-support providers, professional advisers, insurers and auditors where this is necessary to provide or protect the service.
We may disclose information to government, regulatory or law-enforcement authorities where legally required.
Information may also be transferred to a purchaser or successor if our business or the Smart Car Tracker service is sold, transferred or reorganised. Where required, affected users will be appropriately informed.
Service providers may only process information for the agreed purpose and must protect it appropriately.
9. International Data Transfers
Some service providers may process information outside the United Kingdom.
Where personal information is transferred internationally, we take reasonable steps to ensure that appropriate safeguards are used, such as an adequacy decision, approved contractual protections or another legally recognised transfer mechanism.
10. Data Retention
We retain personal information only for as long as reasonably necessary to provide the Smart Car Tracker service, maintain your account and location history, comply with legal, tax and accounting requirements, resolve disputes, enforce agreements and protect our services against fraud or misuse.
Account and tracking information will normally be retained while your account remains active. When an account is deleted, associated personal information will be deleted or anonymised unless some information must be retained for legal, security, fraud-prevention or dispute-resolution purposes.
Information stored in backups may remain temporarily until it is removed through our normal backup-deletion cycle.
11. Account and Data Deletion
You may request deletion of your Smart Car Tracker account and associated personal information through the account settings within the application, where available, or by emailing [email protected].
We may ask you to verify your identity before completing the request. Deleting an account is permanent and may remove access to vehicle history and other stored information.
Certain records may be retained where required by law or reasonably necessary for fraud prevention, security or legal claims.
12. Cookies and Similar Technologies
Our websites and applications may use essential cookies and similar technologies to keep users signed in, maintain security, remember preferences and understand service performance and usage.
Where legally required, we will obtain consent before using non-essential cookies. You can control cookies through your browser or available cookie settings.
13. Security
We use appropriate technical and organisational measures to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.
These measures may include encryption during transmission, access restrictions, authentication controls, monitoring and secure hosting. However, no electronic system can be guaranteed to be completely secure.
Users are responsible for protecting their login information and notifying us if they suspect unauthorised access to their account.
14. Data Breaches
If a personal-data breach occurs, we will investigate it and notify the Information Commissioner’s Office within the legally required period where notification is required.
Where a breach is likely to create a high risk to affected individuals, we will also notify those individuals without undue delay.
15. Your Data-Protection Rights
Depending on the circumstances, you may have the right to request access to your personal information, correct inaccurate or incomplete information, request deletion, restrict processing, object to certain processing, request transfer of information in a portable format and withdraw consent where processing is based on consent.
Some rights may be limited where we have a legal obligation or lawful reason to continue processing information.
16. Complaints
If you have concerns about how we use your information, please contact us first so that we can investigate.
You also have the right to complain to the UK Information Commissioner’s Office.
